By using our Service(legal term) which in practical world means by joining our community or initiating contact with us, you agree to the collection and use of information in accordance with this policy. Its important to note that we do not support slavery or serve anyone , our community belongs to "Free-Humans" who treats everyone equally. Whereas for ease of understanding, this document may contain the word "service" as a easier way to express our state of being or dealing or joining our community events.

1. Information We Collect

We collect information to provide and improve our operations. This information falls into several categories:

A. Information You Provide to Us Directly:

  • Personal and Contact Information: When you book an event, create an account, or use our chat widget, we collect information such as your name, email address, and phone number.

  • Payment Information: To process your bookings, we use Razorpay, a third-party payment gateway. We do not store your full credit card number or payment details on our servers. Your transaction is subject to Razorpay's privacy policy.

  • Communications: When you contact us with questions or feedback, we collect the information within your communications.

B. Information We Collect During Your Participation:

  • WhatsApp Group Information: For coordination purposes, your name and phone number will be used to create a temporary WhatsApp group for your specific event batch. By joining an event, you acknowledge that your name and number will be visible to other participants in that group.

  • Photography and Videography: We frequently take photographs and videos of our events for promotional purposes. By participating, you grant us the right to use your image and likeness in these materials. You have a right to opt-out (see Section 6).

C. Information We Collect Automatically:

  • Device and Usage Information: When you visit our website, we automatically collect your Internet Protocol (IP) address, browser type, operating system, and the pages you visit.

  • Web Push Notification Data: If you opt-in to receive push notifications, OneSignal, our third-party provider, assigns a unique anonymous identifier to your browser or device. We do not collect personal information like email for this functionality.

  • Cookies and Tracking Technologies: We use cookies to track activity on our website and hold certain information, helping us improve your user experience. You can manage cookies through your browser settings.


2. How We Use Your Information

We use the information we collect for the following purposes:

  • To Provide and Manage Our Operations: To process your bookings, manage your account, and deliver our Operations.

  • To Coordinate Your Event: To add you to a WhatsApp group for logistics, updates, and communication related to your specific trek or tour.

  • To Process Payments: To securely complete transactions and prevent fraud via Razorpay.

  • To Communicate With You: To send booking confirmations, updates, receipts, and respond to your inquiries.

  • For Marketing and Promotional Purposes: To use photos and videos from events on our website, social media, and other marketing materials to promote future events. We may also send you marketing emails or push notifications if you have consented.

  • To Share Event Memories: To create and share a Google Photos album link with event participants for collaborative sharing of pictures and videos.

  • For Safety and Security: To comply with legal obligations and enforce our Terms-of-Service and the Eligibility-Condition mentioned on each event details page.


3. Sharing and Disclosure of Your Information

We do not sell your personal information. We may share it in these specific circumstances:

  • With Other Event Participants: As stated above, your name and number will be shared with other participants through the temporary event-specific WhatsApp group.

  • With Third-Party Service Providers: We share information with vendors who perform services on our behalf, including:

    • Razorpay (Payment Processing): For handling financial transactions.

    • OneSignal (Push Notifications): For managing and sending browser notifications.

    • Google Products (Google Sheets, Google Photos etc.. ): For storing lead data from our chat widget and for sharing event photo albums.

    • Local Individuals/Organisations: Vendors like Bus-Hire service provide details of people travelling in the bus/cab/jeep for insurance and RTO permit, in such or similar instances only relevant information is shared to abide by the law or to ensure proper operations.

  • For Legal Reasons: If required by law or to respond to a valid legal request.

  • Business Transfers: In the event of a merger or acquisition, your information may be transferred as a business asset.


4. Data Security

We take reasonable precautions and follow industry best practices to protect your information. Our website uses SSL encryption for data transmission. However, no method of transmission over the Internet is 100% secure, and we cannot guarantee its absolute security.


5. Photography and Media Policy

  • Ownership and Usage: Mischief Treks is by default the owner of all photographs and videos captured by our team, and the images uploaded by participants in the shared Google-Photo album. We reserve the right to use this media for promotional and/or commercial purposes without compensation to the participants.

  • Participant-Shared Media: By uploading your photos and videos to a shared Google Photos album, you grant Mischief Treks a non-exclusive, worldwide, royalty-free license to use, reproduce, and display that media for promotional purposes.

  • Opt-Out Procedure: If you do not want your image to be used by Mischief Treks in promotional materials, you must inform us in writing by sending an email to mischieftreks@gmail.com atleast 24 hours prior to the event/activity date and time. Please include your full name and the name of the event and Booking ID in such Opt-Out requests. We may or may not be able to accept requests sent during or after the event/activity date and time. 


6. Your Rights and Choices

You have rights regarding your personal information:

  • Access and Update: You can request to see or update the personal information we hold about you.

  • Opt-Out of Marketing Communications: You can unsubscribe from our marketing emails via the "unsubscribe" link. You can disable push notifications through your browser settings.

  • Request Deletion: You can request that we delete your personal information, subject to our legal or contractual obligations to retain certain data.

  • Withdraw Consent: Where we rely on consent (like for marketing emails, push notification, WhatsApp updates etc..), you can withdraw it at any time. Please note that withdrawing consent for core activities (like being in a WhatsApp group for coordination) may impact our ability to provide the Operations.


7. Third-Party Links

Our website may contain links to other sites (like our social media pages or Razorpay). We are not responsible for the privacy practices of these other sites and encourage you to read their privacy policies.


8. Children's Privacy

Our Operations are not intended for individuals under the age of 18 participating without parent consent. We do not knowingly collect personal information from children. If you are bringing along Kids, as a parent your consent and information shared by you about the kids will be retained by us for KYC process.

We reserve the right to modify this policy at any time. Changes will take effect immediately upon posting. We will notify you of material changes by updating the "Last Updated" date at the top of this policy.

Fitness -

  • It is most essential to be fit and fine before heading for an event. While planning your trip, it is preferable to have a medical fitness check up done. If suffering from any kind of allergy or ailment, do carry proper prescribed medicines to prevent serious health problems including heatstroke, severe headache, cough, dehydration and hypothermia. Participants suffering from chronic conditions like asthma, bronchitis, blood pressure, migraine, diabetes etc should seek their physician's advice before coming.

Damage to Public Property -

  • Participants should not deface or damage any monument by writing or scribbling on them. Please help us to conserve and preserve our heritage .

Starting/Pickup Point

  • The participants who wish to reach the event starting point in their own vehicle have to reach the meeting point at given time, beyond the said time and spot the organizer may go out of network range and won’t be able to assist. In such a situation the organizer shall not be liable for any inconvenience what-so-ever and the participants will be considered as drop-out against which no refund will be made.

Safety -

  • The organizer reserves the right to make necessary changes in itinerary at any time before or during the event based on the situation at hand. Trek leaders' decisions will be final and binding, no arguments will be entertained. During the event, if any participant or group does not follow safety instructions and indulges in acts that lead to physical harm, or gets lost in the forest / mountain the organizers will not be held liable for it.

Security -

  • We do not allow anyone to camp until we have complete and authentic details of the person. This info is crucial in case of emergency, and is a mandatory KYC parameter. Submitting incomplete/incorrect/fake details in the form will make your booking invalid and no refund will be provided in such a case.

In Between the event -

  • No refund will be made in case a person misses the train/bus mentioned in the itinerary. All participants are deemed to be physically fit for the event. In case a participant decides to dropout during the event he/she has to bear the extra cost of arranging his/her return, this cost will be charged at-actual-basis.

Act of God -

  • If the event gets cancelled before commencement due to natural calamities, rains, landslide, snowfall, avalanche or any external influencers, only 50% refund will be made (provided full payment is made while booking) no refunds are provided on partial payment made for booking. Once the event has started and if it gets cancelled due to bad natural conditions during the course of the event no refund will be made.

  • Delays due to traffic conditions, weather, participants endurance, vehicle breakdown etc. are not in our hands and participants need to bear with the situation as a team.

Weather Dependency -

  • Stay options mentioned in the itinerary are subject to natural conditions i.e. tents can’t be pitched if rains and/or rain storm is being predicted. In such cases an attempt will be made to provide shelter for the night. Food during the trekking and camping events is sourced locally from villages and we put in our best efforts to provide the best, participants should acknowledge the fact that remote village people are not trained for catering services and the expectations should be accommodating.

Weather Dependency -

  • Stay options mentioned in the itinerary are subject to natural conditions i.e. tents can’t be pitched if rains and/or rain storm is being predicted. In such cases an attempt will be made to provide shelter for the night. Food during the trekking and camping events is sourced locally from villages and we put in our best efforts to provide the best, participants should acknowledge the fact that remote village people are not trained for catering services and the expectations should be accommodating.

Community of interests -

  • Mischief Treks organises events at forts, lakes, villages, hills and mountains that are accessible to other organisers too. We do not own any of the locations mentioned. We do not have access to the client booking database of other organisers and we cannot comment on the number of people visiting the location on a given date. Mischief Treks has a reputation of providing memorable experiences for trekkers and adventure lovers, our events are not designed for tourists or fussy people. Trekking and Camping belong to the adventure sports industry where the participants are part of a "team" where there are no waiters, caterers, guests, or clients. We all will be part of the team and your participation as a team member is appreciated. Having the spirit of sportsmanship and teamwork is a basic requirement for signing up for our events. Pictures and videos captured by our staff/members during the event are property of Mischief Treks and we reserve rights to publish the images as per our discretion.

Photography and Videos -

  • All the photos and videos shared in the common album of the given event are free-to-use by Mischief Treks and participants of the event. Pictures and Videos clicked by team members of Mischief Treks are copyright work of the respective team members and can be used for promotional purposes of Mischief Treks events.

  • If a participant has reservations or apprehension regarding his/her pictures, he/she needs to give a prior intimation to Mischief Treks (before the pictures/videos are shot) on the official WhatsApp number 7719800777.

  • Mischief Treks team members like to click pictures and shoot videos during the event and they do so at their sole discretion. They are under no obligation to do so unless specifically they have been hired by a participant for the photoshoot by making additional payment.
